Fort Hood suspect may be eligible for death penalty

Maj. Nidal Malik Hasan, facing 13 counts of premeditated murder, made his first in-person court appearance, before Col. James Pohl, and won a request to delay the trial for four months.
Authorities said the hearings could have been held as early as July 1 if Col. Pohl hadn't granted the request of Maj. Hasan's defense attorney, John Galligan, to delay them until Oct. 4.
The Army psychiatrist's appearance at the small fortified military courthouse at Fort Hood marked his first time on base since the Nov. 5 shootings that left 13 dead and 32 wounded. Maj. Hasan will be tried under Article 32, which outlines the protocols for investigating an officer.
The delay also puts off expected prosecution efforts to make Maj. Hasan eligible for the death penalty.
Prosecutors had been expected to ask that the case be changed from a summary court-martial case to a general court-martial case under the Uniform Code of Military Justice. Only the latter type of case allows for capital punishment, and guilty pleas are not allowed in capital cases.
Summary court-martial cases consist of only one commissioned officer, while general court-martial cases involve no less than five members and a military judge, and run more like civilian criminal cases.
